Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cipher8 website and the Cipher8 CISSP training application (the "Service"), provided by Cipher8 ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

1. The Service

Cipher8 is an independent online study tool that helps users prepare for the CISSP examination through adaptive practice, FSRS spaced repetition, confidence calibration and a mistake journal.

CISSP® is a registered trademark of ISC2, Inc. This product is not sponsored or endorsed by ISC2, nor is it affiliated with ISC2.

2. Eligibility and accounts

You must be at least 16 years old to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. You are responsible for keeping your credentials confidential and for all activity under your account, and for providing accurate information and keeping it up to date.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Engage in fraud, spam or any deceptive practice.
  • Infringe the intellectual-property rights of Cipher8 or any third party.
  • Reverse engineer, decompile or attempt to derive the source code of the Service except to the extent permitted by law.
  • Resell, redistribute or sublicense access to the Service.
  • Circumvent technical limits, including paywalls or rate limits.
  • Probe, scan or otherwise interfere with the security or integrity of the Service, or upload malware.
  • Scrape, harvest or bulk-export content from the Service.

4. Subscriptions, payments and taxes

Cipher8 offers a free tier (Domain 1) and a paid Pro subscription (all 8 domains) at $9.90 USD per month or $79 USD per year. Paid subscriptions renew automatically on the chosen billing cycle until cancelled.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation and refund mechanics are governed by Paddle's Buyer Terms.

5. Licence

Subject to these Terms, Cipher8 grants you a limited, non-exclusive, non-transferable, revocable right to use the Service for your personal study purposes within the plan you have purchased.

6. Intellectual property

Cipher8 and its licensors retain all right, title and interest in and to the Service, including all software, content, documentation, branding and trademarks. Nothing in these Terms transfers ownership to you.

7. User content

You retain ownership of any content you submit to the Service (such as notes or feedback). You grant Cipher8 a worldwide, non-exclusive, royalty-free licence to host, store and process that content solely to provide and improve the Service.

8. Service level

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free or fit for any particular purpose. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the fullest extent permitted by law, Cipher8's aggregate liability arising out of or relating to these Terms or the Service is limited to the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential or exemplary damages, including loss of profits, goodwill, data or opportunity. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnity

You agree to indemnify and hold Cipher8 harmless from any claim or demand arising from your user content, your misuse of the Service or your breach of these Terms.

11. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay applicable fees, create a security or fraud risk, or repeatedly or seriously violate our policies. You may close your account at any time by contacting us. On termination, your right to use the Service ceases and we may delete your account data subject to legal retention obligations.

12. Changes

We may update these Terms from time to time. Material changes will be communicated in the Service or by email. Continued use of the Service after the effective date means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Cipher8 is established, without regard to conflict-of-laws principles. The courts of that jurisdiction have exclusive jurisdiction over any dispute arising from these Terms, except where mandatory consumer-protection law provides otherwise.
